A refused super visa is usually fixed by reapplying with the gap closed, not by appeal. Visa refusals cannot be appealed to the Immigration Appeal Division; the only legal challenge is an application for leave and judicial review at the Federal Court, filed within 60 days of a decision made outside Canada, and it reviews legal error rather than re-deciding the case, per Silaws. Order the GCMS notes to read the officer’s reasoning, fix the income, insurance or intent problem, and claim the insurance refund with the refusal letter.
IRCC approves 75 to 81% of super visa applications, per its report to Parliament, so roughly one in five files is refused. Most are refused for a reason that can be corrected in a second application.
Why was the super visa refused?
For one of four reasons in almost every case: income, insurance, intent, or an incomplete file. IRCC’s after you apply page says an incomplete application may be refused and that IRCC sends an explanation. The letter names the category; the GCMS notes name the cause.
| Reason | What the officer saw | Fix for the reapplication | Source |
|---|---|---|---|
| Income not demonstrated | NOA below the minimum for the family size; co-signer not counted; family size miscounted | Use either of the two preceding tax years; add a co-signing spouse; use the 75% + 25% option; recount family size | IRCC Mar 2026 notice, officer instructions |
| Insurance non-compliant | A quote; under $100,000; under 1 year; broker named instead of the underwriter; a foreign insurer not on OSFI’s list | A paid certificate naming the underwriter, $100,000, 1 year from entry, Canadian insurer or OSFI-listed foreign insurer with the required statement | IRCC forms and documents, OSFI list |
| Not satisfied the parent will leave | Weak ties, unclear purpose, inconsistent travel history | Evidence of property, pension, other family and return plans; a clear purpose paragraph in the letter | Silaws, IRCC eligibility |
| Incomplete application | Missing status proof, relationship proof, translations, medical confirmation | Full checklist; upfront medical exam | IRCC after you apply |
| Medical inadmissibility | Danger to public health or excessive demand | Specialist reports; immigration lawyer | IRCC officer instructions |
| Misrepresentation | False or incomplete information | Five-year bar; legal advice essential | Silaws |
Indian, Filipino and Pakistani domestic insurers such as Tata AIG, Bajaj Allianz, ICICI Lombard, Niva Bupa and Star Health are not on OSFI’s list, and a policy from one of them is a refusal, not a near miss. There is no IRCC-approved list of foreign insurers; the test is OSFI’s register.
Reapply, or go to Federal Court?
Reapply, for nearly every family. A new application with the problem fixed costs $100 plus $85 biometrics and takes 44 to 116 days depending on the country. Judicial review costs legal fees, takes longer, and a win sends the file back to a different officer for a new decision rather than granting the visa.
| Route | Who decides | Deadline | Cost | Outcome if successful | Source |
|---|---|---|---|---|---|
| Reapply | A visa officer, fresh application | None; file when the gap is closed | $100 + $85 + new medical if expired | Visa issued | IRCC how to apply |
| Request reconsideration | Same visa office | Before reapplying; discretionary | Free | Rarely changes a refusal | Silaws |
| Judicial review | Federal Court | 60 days from a decision made outside Canada (15 inside) | Legal fees | File sent back for redetermination | Silaws |
| Immigration Appeal Division | Not available for visa refusals | n/a | n/a | n/a | Silaws |
Judicial review is worth a lawyer’s opinion when the officer ignored evidence that was in the file, for example a compliant certificate refused as a quote. It is not worth it when the file was short.
How do you get the GCMS notes, and why?
Through an access to information request, because the refusal letter gives a category and the notes give the reasoning. File through the ATIP online portal: $5 under the Access to Information Act, or free under the Privacy Act for your own information. An applicant outside Canada must name a Canadian citizen or permanent resident as representative with a signed consent form. IRCC has 30 days to respond, with extensions possible, and the notes arrive as a PDF, per Silaws.
Order the notes the day the refusal arrives, and if judicial review is a possibility, file the leave application inside the deadline rather than waiting for the notes.
How do you get the insurance refunded?
Send the IRCC refusal letter to the carrier before the policy’s start date. Most carriers refund in full on a refusal; some deduct an administration fee; all need the letter.
| Carrier (underwriter) | Refund on IRCC refusal | Condition |
|---|---|---|
| Manulife CoverMe (Manufacturers Life) | Full | Refusal letter, before start date |
| 21st Century Travel (Manulife) | Full | Before start date, proof within 30 days |
| Travelance (Old Republic Insurance Company of Canada) | Full, no fee | Within 30 days |
| Destination Travel Group (Zurich Insurance Company Ltd, Canadian Branch) | Full | Before the effective date |
| GMS (Group Medical Services) | Full less administration fee | Refusal letter |
| Secure Travel (iA Financial Group, claims by MSH) | Full less administration fee | Refusal letter |
| MSH | Full | Within 60 days |
| TuGo (iA Financial Group) | Confirm at quote time | Cancellation fee $250 otherwise |
| Allianz Global Assistance (CUMIS General Insurance) | Confirm at quote time | Confirm with the insurer |
Source: SuperVisaDirect carrier fact sheet, October 2026; verify at quote time. If the policy has already started because the start date was not moved, the refund is pro rata at best and only if there were no claims; see refunds. Keep the refunded policy’s details, because the reapplication will need a new certificate with a new start date.
What should the second application look like?
The same file with the refusal reason answered in the first paragraph of the letter of invitation and in the evidence. If income was the issue, show the arithmetic against the current table using the option now relied on. If insurance was the issue, use a certificate that matches the sample line by line. If intent was the issue, add ties evidence and a return plan. Check the medical exam is still within its 12 months and that biometrics are still valid.
SuperVisaDirect is operated by Super Visa Direct Insurance Services, an independent Ontario life and accident-and-sickness insurance agency licensed by FSRA (licence [FSRA-LICENCE]), serving Ontario residents; British Columbia, Alberta, Saskatchewan and Manitoba are planned for 2028. Designated licensed agent: Cameron Hayes. We handle the insurance refund and the replacement certificate; we do not give immigration or legal advice, and judicial review needs a lawyer. Questions people ask
Why are super visas refused?
Mostly for income not demonstrated, insurance that does not meet IRCC's wording, and doubts that the parent will leave Canada. Approval runs 75 to 81%, so one in four or five files fails. The refusal letter gives a category; the GCMS notes give the officer's actual reasoning, which is what you need before reapplying.
Can I appeal a super visa refusal?
Not to the Immigration Appeal Division; visitor visa refusals are not within its jurisdiction. The only legal challenge is an application for leave and judicial review at the Federal Court, filed within 60 days of a decision made outside Canada. It reviews legal error, does not re-decide the case, and usually sends a successful file back to a different officer.
Should I reapply or go to Federal Court?
Reapply, unless the refusal rests on a clear legal error and a lawyer says so. A new application with the gap closed takes 44 to 116 days and costs $100 plus $85; judicial review takes longer, costs legal fees, and at best sends the file back for a new decision. Reapplying without fixing anything produces the same refusal.
How do I get the GCMS notes?
File an access to information request through the ATIP online portal; the fee is $5, or free under the Privacy Act for your own information. An applicant outside Canada must use a Canadian citizen or permanent resident as representative with signed consent. IRCC has 30 days to respond, with extensions possible, and the notes arrive as a PDF.
Does the insurance get refunded if the super visa is refused?
At most carriers, yes, with the IRCC refusal letter, if the policy has not started. Manulife, 21st Century (proof within 30 days), Travelance (no fee, 30 days), Destination (before the effective date) refund in full; GMS and Secure Travel refund less an administration fee; MSH within 60 days. Send the letter the week it arrives.
Will a refusal hurt the next application?
Only if the new file repeats the problem. A refusal is on record and the next officer will see it, so the new application should address the stated reason directly: a co-signer or the 75% plus 25% option for income, a compliant certificate naming the underwriter for insurance, stronger ties evidence for intent. A misrepresentation finding is different and carries a five-year bar.
